MINUTES OF OKEFORD FITZPAINE PARISH COUNCIL MEETING

HELD AT THE PAVILION ON 2 OCTOBER 2012

2. THE MINUTES OF PARISH COUNCIL MEETING 4 SEPTEMBER 2012: having been circulated to Cllrs and noticeboards were taken as read. It was proposed by Cllr Paine and seconded by Cllr Fox they be signed by the Chairman, this was agreed.

3. POINTS FROM THE PUBLIC RELATING TO ITEM 6 ONLY. None

4. DECLARATIONS OF INTEREST

 Members were reminded of the need to declare an interest if it was not already disclosed on their declaration of disclosable pecuniary interest form held by the Clerk.

5. District & County Councillors’ Report: Cllr Burch reported that NDDC had successfully bid to be part of the local authority pilot schemes with regard to universal credit. Schemes will start this autumn and will explore how Councils can support residents under the new system. Universal Credit is designed to be delivered on line, however there were a lot of residents in North Dorset without computers, NDDC were looking for funding to enable face to face enquiries to be dealt with. Local Authorities were responsible for Universal Credit for 1 year and then it would be taken over by the D.W.P. The chosen pilot authorities would report any problems to the D.W.P.

 The council had a debate on the benefit of doing a pilot after the system had been introduced nationally, whilst they understood the particular position of NDDC other areas would have difficulties and it is usual to hold a pilot in a specific and controlled location to iron out difficulties before a system is introduced on a wider basis, but the government had not followed this path and the Council could only monitor the introduction as it has been decreed.

6. MATTERS ARISING

6.1 Recreation Ground/Pavilion to include Recycling Centre Items: Cllr Corben advised that he would ring the contractor with regard to the floor tiling in the new extension, he also agreed to put up the new plaque. Cllr Burt advised that he had spoken to insurance company as per the last meeting and there were no problems. He had purchased new push button taps and refurbished the sink.

6.2 Bowey Field: N.F.T.R.

6.3 Village Hall Extension and Car Park: Cllr Burt advised that the builders were being asked to provide new details estimates for the work needed.

   1. Community Planning: Cllr Burt had circulated the latest CPEND minutes to all Councillors.

   2. Belchalwell & Fiddleford Items: None

   3. Actions Highlighted in the Parish Plan: Mrs Deary advised that she had written to DCC regarding the request for a 20mph speed limit in the village, no response had yet been received. She had also written to NDDC regarding Adequate Parking for new houses, a receipt of acknowledgement had been received but nothing further.

   1. Home Watch: The next meeting would take place at 10.30 am on 8 November 2012.

   2. Land at top of Back Lane: Mrs Deary advised that Mr J Cousens, NDDC Enforcement department had attended a site meeting with the owner on Tuesday 2 October 2012. He had reported as follows:

“The Enforcement Notice: ENF/2009/0143(1) detailed the buildings on the land and this was subject Notice was subject to an appeal. The Appeal Decision was made on 4^th April 2011 where the Inspector varied the Notice as some of the buildings were found not to amount to operational development. However other buildings were found to be operational development and a breach of planning control. It is these buildings that I went to see.

  I ascertained from my visit that a number of these ‘buildings’ are still in place and therefore in breach of the Enforcement Notice.

  The Enforcement Notice: ENF/2009/0143(2) detailed a substantial amount of wood, trailers, vehicles and miscellaneous items, some of which are badly described within the Notice and cannot be enforced against. I acknowledge that Mr Clancy has removed a substantial amount of items from the land , however, there are items, vehicles etc. which are still in place and this too, is in breach of the Enforcement Notice.

  I went through each and every item as detailed in both Enforcement Notices with Mr Clancy and when I recognised early on that an offence had been committed, he was cautioned as required within the Police and Criminal Evidence Act and his explanations where all recorded.

  I have obtained photographic evidence to prove the offences.

  At the end of my site visit, I formally reported Mr Clancy for failing to comply with the steps within both Enforcement Notices and therefore he has committed criminal offences. This is contrary to Section 179 of The Town and Country Planning Act 1990, as amended. He was formally given the appropriate caution, as required by law when one has reported an individual for the offences.

  I will now prepare two prosecution files in respect to the offences and submit them to the Council’s Legal Services.”

   1. The Queen Elizabeth II Fields Challenge: Cllr Burt had forwarded an email from FIT asking people to vote for their local field.

   2. Okeford Fitzpaine Housing Survey Results: Mrs Deary advised that she had written to the Chief Executive of NDDC concerning this matter, an acknowledgement had been received saying that Mrs Goodall was on holiday until 24 September and the issue would be brought to her attention on her return, in the meantime Trevor Warrick, Planning Policy Manger was asked to provide a response. No response had yet been received.

   3. Beacon Sign: The Beacon sign had now been received, Cllr Burt agreed to install the sign.

   4. Allotments: N.F.T.R.

   5. Code of Conduct: It was agreed that this item should now be discharged from the agenda.

   6. Electronic Planning Applications: A meeting to update parishes on electronic Planning Applications had been set up for Tuesday 9 October 2012 at NDDC. Cllr Burt advised that planning applications could now be viewed online.

   7. Replacement Notice Board: N.F.T.R.

   8. Funding for School Marketing Campaign: Following discussions it was agreed that the only way the Parish Council could assist the school with funding was for a particular project, i.e. new computers. Donations could only be made to the PFA and would need to show a benefit to the whole community. Mrs Deary to write to the school and inform them of this.

7. PLANNING MATTERS:

7.1 Applications: None

7.2 Decisions: 2/2012/0808/PLNG – Stans Yard, Okeford Fitzpaine, Dorset – Erect 1 dwelling with 2 parking spaces – REFUSED.

2/2011/1336/PLNG – Land at Wessex Park Homes, Shillingstone Lane, Okeford Fitzpaine, Dorset, DT11 0RB – Extension of time for implementation of Planning Permission 2/2009/0672/PLNG to erect 1 x replacement factory with ancillary offices, storage and parking – GRANTED.

2/2012/1034/PLNG – 20, Castle Avenue, Okeford Fitzpaine, Blandford Forum, Dorset, DT11 0RY – Erect 1 No. single storey extension – GRANTED

7.3 Any other planning matters: Mrs Deary advised that she had written to development Management Services at NDDC with regard to the temporary road on Okeford Hill. Mr Cousens had attended site but did not see the temporary road, Mrs Powell, Development Management Officer was now waiting for the land owners agents to contact her to discuss the matter.

7.4 Updates: 2/2011/1265/PLNG, Land at: Okeford Hill, Back Land, Okeford Fitzpaine – Erect 1 x single storey dwelling, 1 x mobile home and 5 x parking spaces. Erect stables to house 26 horses. Mrs Deary advised that she had received an email from Mrs Rogerson, NDDC to inform the Council that the conditions imposed relating to the above application, prior conditions and otherwise, have now been complied with, including the landscaping condition which will be implemented in Autumn 2012, where upon a further site visit will be undertaken to ensure this planting has been done in strict accordance with the scheme submitted. Concerns were raised with regard to rain water harvesting on the site. Mrs Deary was asked to contact the Development Management Services department asking for a copy of the building regulations.

11.1 Annual Accounts: Mrs Deary reported that the Audit for year ending 31 March 2012 had now been completed. It was advised that the Council’s asset register did not contain the following information for each asset held:

• Date acquired

• Purchase cost

• Location held

The Council must update its fixed asset register to include the above information before the end of the current financial year.

It was proposed by Cllr Paine and seconded by Cllr Fox that these be paid. This was agreed by Council.

1. ANY OTHER BUSINESS: Three letters had been handed to the clerk requesting a grit bin for Back Lane. Cllr Burt advised that DCC were to undertake inspections of all grit bins to ascertain if they were community or strategic grit bins. The filling of community grit bins would need to be funded by the Parish Council, filling strategic grit bins would be funded by DCC. Following discussion it was agreed that Mrs Deary would write to the 3 residents informing them that the Parish Council were not prepared to look at funding more grit bins with the high capital cost involved and also the cost of filling the grit bins. The Parish Council would need to consider this when setting the budget for next year when it was hoped that more information on what the County Council considered ‘strategic’ would be available.

The agenda for the next cross boundary meeting had been distributed to Councillors, Cllr Burt agreed to attend the meeting which would be held on 11 October.

Cllr Burt was concerned that no information regarding the Police Crime Commissioners election being held in November had been circulated. Mrs Deary was asked to write to the Chief Executive of NDDC asking if any meetings with the candidates were being set up.
